Deal Tri Event Entry Terms and Conditions

Definitions:

Conditions means these terms and conditions of entry for the Event;
Deal Tri means Deal Tri Limited, company incorporated and registered in England and Wales as a private company limited by guarantee with registered number 05034075;
Entry Fee means the price of entry into the Event as determined from time to time;
Entry Form means the form which must be completed in order to participate in the Event;
Event means any event organised by Deal Tri Limited from time to time; and
Competitor means the person named on the Entry Form who will be participating in the Event.

1 Application of Conditions
1.1 These Conditions shall apply to any Event organised by Deal Tri and shall prevail over any terms and conditions contained in or referred to in any documentation submitted by, or correspondence with, the Competitor. The Competitor should read these Conditions carefully prior to registering for the Event. These Conditions represent a legally binding agreement between the Competitor and Deal Tri.
1.2 These Conditions may only be varied by Deal Tri giving a written notice to the Competitor in any official Event material or correspondence (including email) prior to the date of the Event.

2 Conditions of Entry
2.1 The Competitor agrees and acknowledges that participating in the Event is physically strenuous. It involves a risk of serious injury or death from various causes including exertion, equipment failure, accidents, dehydration, other road users, bad weather conditions and other causes.
2.2 The Competitor agrees that he/she is physically capable of competing in the Event and agrees to be solely responsible for his/her actions and Deal Tri, its officers, employees, agents, affiliates, associated companies, sponsors or medical advisers are not responsible for any injury or illness that the Competitor may suffer as a result of his/her participation in the Event. The Competitor understands and acknowledges that he/she should not participate in the Event if he/she has any health concerns.
2.3 The Competitor must comply with the age requirements for the Event as stated on the Entry Form. The Competitor agrees to abide by all race rules and instructions issued by Deal Tri in relation to the Event.
2.4 The Competitor acknowledges that by reason of circumstance outside the control of Deal Tri, it may be necessary to change the format of the Event, in which case the Competitor consents to changes and agrees that each of these Conditions shall apply to such changed Event.
2.5 The Competitor gives permission to the Event staff to make decisions concerning medical care and treatment, and where necessary to authorise such care and treatment in emergency situations. The Competitor understand that the Event staff will make every reasonable effort, in the circumstances, to reach the Competitor’s emergency contact (if the Competitor has supplied one to Deal Tri prior to the Event) regarding the Competitor’s medical status in the event an emergency arises. In the event that the Competitor’s contact cannot be reached in an emergency, the Competitor gives his/her permission to the licensed physician, dentist, athletic therapist, nurse or other medical professional whose services might be required to provide medical care and treatment.
2.6 The Competitor acknowledges and understands that personal accident and personal items insurance coverage is his or her sole responsibility.

3 Cut off Times and Removal
3.1 Deal Tri may introduce cut off times as part of the Event rules, being limits on the time taken to complete sections or whole of the Event to ensure safe and proper running of the Event. As a result, Competitors may be requested to withdraw from the Event in accordance with the imposed cut-off times.
3.2 Deal Tri reserves the right at any time to remove the Competitor from the Event or prevent the Competitor from participating in the Event if in Deal Tri’s sole discretion, it considers such action necessary for safety reasons or proper enjoyment of the Event by other Competitors or for any other reasonable reason. No refund of the Entry Fee shall be made if the Competitor has acted negligently, maliciously, with wilful misconduct or otherwise without due care and attention for the Event or other Competitors, so as to cause his/her removal.
4 Bookings and Payments
4.1 In order to take part in the Event the Competitor must pay the Entry Fee no later than the date set out on the Entry Form.
4.2 The Competitor shall not be entitled to take part in the Event until full payment of the Entry Fee has been received by Deal Tri. No payment shall be deemed to have been received until Deal Tri is in receipt of cleared funds.
5 Withdrawal, Cancellations or Alterations
5.1 Places in the Event are sold on a non-changeable, non-transferable basis.
5.2 Deal Tri reserves the right to change the date of the Event. In the event Deal Tri changes the date of the Event, and the Competitor is unable to attend on the revised date, the Competitor will have 14 days to inform Deal Tri in writing from when the change in date is announced to receive a refund of the Entry Fee.
5.3 Deal Tri reserves the right to withdraw the offer of a place in the Event to the Competitor for any reason and at any time, and in such circumstances, Deal Tri shall provide the Competitor with a full refund of the Entry Fee with no further liability arising from such withdrawal.

5.4 Deal Tri reserves the right to amend the Event format or cancel the Event due to circumstances beyond it reasonable control or for any safety related reason. In the event of the Event being cancelled Deal Tri shall provide the Competitor with a full refund of the Entry Fee with no further liability arising out of such cancellation.
6 Limitation of liability
6.1 Notwithstanding anything in these Conditions, Deal Tri shall not be liable to the Competitor for any loss of business, revenue or profits, loss or damage of personal equipment belonging to the Competitor, any indirect or consequential losses (in any case whether or not such losses were within the contemplation of the parties at the date the Competitor submitted the Entry Form) suffered or incurred by the Competitor arising out of taking part in the Event or any other matter arising under these Conditions nor for an aggregate amount higher than the Entry Fee paid by the Competitor.
6.2 Nothing in these Conditions removes or limits Deal Tri’s liability for fraud or fraudulent misrepresentation, death or personal injury caused by Deal Tri’s negligence or for any liability which cannot be limited or excluded by the law.
6.3 Without limitation to the foregoing, Deal Tri shall not be liable for any actions of any spectators or other third parties unless otherwise set out in these Conditions.
7 Publicity and results
7.1 The Competitor irrevocably consents to:
(i) his/her appearance in the Event being filmed, recorded, incorporated and exploited in whole or in part in any television programme, film, video or broadcast of whatever nature by all means and in all media and formats now or invented after the date of these Conditions; and

(ii) the use and reproduction of his/her name, likeness, appearance and photographs, films and recordings by all means and in all media for the purpose of advertising, publicity and otherwise in relation to the exploitation of the Event and/or the promotion of the Event and the commercial rights relating to the Event provided that such use does not imply direct endorsement by the Competitor of any official sponsor or supplier of the Event.

7.2 Deal Tri shall use its best endeavours to provide an Event finish time for the Competitor. However, Deal Tri shall not be held responsible for any result anomalies or any technical malfunctions.

8 General
8.1 These Conditions (and the documents referred to in them) constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the Event.
8.2 The Competitor acknowledges and agrees that by submitting the Entry Form (and the documents referred to in it) he/she shall not rely on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person (whether party to this Agreement or not) other than as expressly set out in these Conditions.
8.3 If any provision of these Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Conditions, shall be enforced to the fullest extent allowed by law as to effect the intention of the parties, and shall not affect the validity and enforceability of any remaining provisions.
8.4 No waiver by either party of a breach or a default hereunder shall be effective unless in writing and signed by both parties and any such waiver shall not be deemed to be a waiver of any subsequent breach or default of the same or similar nature.
8.5 These Conditions form a legally binding agreement between the Competitor and Deal Tri. These Conditions shall be governed by English law and any dispute arising under the Conditions shall be subject to the exclusive jurisdiction of English courts.
